INTRODUCTION

Welcome to our website. These General Terms and Conditions of Sale (GTC) govern all transactions made on this site by professional customers (B2B). The site is operated by Air-Qualitee by V Plus Habitat GmbH, located at Untermüli 11, 6300 ZUG, Switzerland, France, and can be contacted via email at info@air-qualitee.com. The French entity is your primary point of contact for all orders, while the Swiss company will be responsible for invoicing.

SCOPE

These terms apply to all sales of products made through our website. By placing an order, you unreservedly accept these GTC and acknowledge that you have reviewed the necessary information before confirming your purchase. These GTC take precedence over any other document or conditions originating from you.

ORDER PROCESS

Orders can be placed online through our website. You will need to create a customer account to place an order. Any order implies acceptance of the prices and descriptions of the products available for sale. Upon receipt of your order, World Sellers SAS will send you an acknowledgment of receipt. The order is considered accepted only after our confirmation. The acceptance of the order will be confirmed by the sending of a confirmation email by World Sellers SAS. We reserve the right to refuse an order for any legitimate reason, including supply issues, prior disputes with the customer, or anomalies in the order.

INVOICING AND PAYMENT

Accepted payment methods will be specified at the time of order. Invoices will be issued in Euros, and payments must be made in this currency. In case of late payment, late fees may be applied according to the legal interest rate in force. We reserve the right to suspend or cancel any order or delivery in case of delay or payment issues.

DELIVERY AND TRANSFER OF RISK

Delivery times will be specified when the order is confirmed. Delivery costs are the responsibility of the customer, unless otherwise specified. The risk of loss or damage to the products is transferred to the customer upon delivery. It is the customer’s responsibility to check the condition of the products upon receipt and to make any necessary claims.

PRODUCT AVAILABILITY

In case of out-of-stock or delay, we will inform you as soon as possible. You will have the option to maintain, modify, or cancel your order. In case of cancellation, a refund will be made within 14 days.

RETURN AND REFUNDS

Returns are accepted under the conditions specified in the order confirmation. Returned products must be in perfect condition and in their original packaging. Returns are the responsibility of the customer, unless otherwise specified. Refunds will be made after verification of the returned products. The refund will be made via the same payment method used for the purchase.

LIMITATIONS OF LIABILITY

We cannot be held responsible for indirect damages, loss of profits, or any other harm resulting from the use of the products or non-compliance of the products with the customer’s expected specifications. Total liability for any direct damage is limited to the amount paid by the customer for the products in question.

INTELLECTUAL PROPERTY

All content on this site, such as texts, images, and logos, is protected by intellectual property laws. Any unauthorized reproduction or use of the content is strictly prohibited. You are granted a limited license to use the site for the purpose of placing orders. Any use not in accordance with these GTC may result in sanctions, including suspension of the account.

DATA PROTECTION

Your personal data will be collected, used, and protected in accordance with the GDPR (General Data Protection Regulation). Your data may be shared with V Plus Habitat GmbH only for the purpose of fulfilling your order. You have the right to access, modify, and delete your personal data.

GOVERNING LAW AND JURISDICTION

​These GTC are governed by French law. Any dispute related to these terms will be subject to the exclusive jurisdiction of French courts. The parties will make every effort to settle any dispute amicably before taking legal action.

MODIFICATIONS TO THE TERMS

We reserve the right to modify these GTC at any time. You will be informed of these changes by email or via our website. The changes will apply to all orders placed after they are posted online.

FORCE MAJEURE

Air-Qualitee and V Plus Habitat GmbH cannot be held responsible for the total or partial non-performance of their obligations in the event of a force majeure event (war, natural disaster, pandemic, interruption of telecommunications networks, etc.).
